Train Accident Cases
Our attorneys represent victims of train accidents
and negligence at railroad crossings.
According to the National Traffic Safety Board, the
federal agency responsible for investigating plane and train wrecks, problems
with train tracks related are responsible for as many as 1000 accidents
a year. Track related failure is the largest single cause of train derailments
and major accidents, including the Amtrak crash of the California Zephyr
east of Des Moines, Iowa which killed one, seriously injured 15 and resulted
in more than 75 other injuries.
Track Failure and Derailments
Track derailments are caused by a number of factors, most stemming from
poorly maintained sections of track. Often the two tracks loosen and separate
over time resulting in what is called "wide gage", when this
occurs the distance between the two rails expands creating a dangerous
condition.
Other failures can occur as the track warps or develops weak points after
heavy use. Many accidents result from faulty switches and equipment used
to move trains and freight at turnouts and junctures where trains are routed
to different locations. There are an estimated 223,000 miles of track in
the US, regrettably much of it goes un-inspected and un-maintained for
long periods.
Only after a catastrophic failure and major accident do the rail and tracks
get the proper inspection. By then it is, of course, too late. Lawyers
representing the injured can argue that the accident could have been prevented
through proper track inspection and track maintenance by the railroad companies.
Railroad Crossing Accidents
When a ordinary motorist comes into contact with
a train, the results are predictably horrific, in fact an ordinary motorist
is estimated to be thirty times more likely to be killed in a collision
with a train than with any other type of vehicle. The famous 20th century
artist N.C Wyeth and his grandson were killed in a car train collision,
after their car stalled on the tracks of a railroad crossing. Each year there are around 500 people killed at rail crossings,
and more than 1,800 injured in such accidents.
We represent victims of train accidents, on
board or at railroad crossings, who are injured by railroad negligence.
